Minutes of the Baroda Township Board Meeting

June 21, 2010

 

The regular meeting of the Baroda Township Board was called to order at 7:30 p.m. by Supervisor Jim Brow in the meeting room of the Baroda Township Municipal Building. Those present: Jim Brow, Amy Hemphill, Susan Newcomer, Wendie Shafer, and David Wolf, along with four audience members.

 

LIBRARY REPORT – Dave Bailey from the Lincoln Township Public Library reported that Dina Reilly plans to retire in July for health reasons and that he will attend future Township meetings until her replacement can be found.  He reported that nearly 800 people have signed up for the summer reading program.  He said that the theme of many of the activities for the summer will be centered on the NASA exhibit that will be on display at the Library this summer.

 

DEPARTMENT REPORTS   Chief Gary Ruhl reported that the Police Department has move into the new Public Safety building at Lake Charter Township.  He said that the Police Department is preparing for the July third Fireworks display and would like to use the Municipal Building as their headquarters for that evening.  John Hopkins brought canine officer Elmo to “meet” the Township Board and audience.  John reported on the types of training Elmo has done and that they go for training every two weeks.

 

TREASURER’S REPORT  - Checking Account Totals:

Susan Newcomer distributed and presented the Treasurers report.

 

CLERK’S and PLANNING COMMISSION REPORT – Wendie Shafer Read a letter from Tom Carson thanking and commending the Fire Department for having three fire trucks stationed at the main intersections in support of the procession of the Lest We Forget Memorial Wall.

 

Shafer presented a Budget report recommending budget amendments for several line items.  Jim Brow moved, seconded by Amy Hemphill to approve the proposed budget amendments. Vote – All yes.  Motion Carried.

 

Shafer reported that the Planning Commission had held a public hearing to approve the adoption of the Master Plan and had adopted a resolution to recommend to the Township Board to adopt a resolution to approve the Master Plan.  David Wolf requested page 51 Water distribution map be corrected to show the water lines going past Ruggles Road on Lemon Creek Road.  Dave Wolf moved, seconded by Susan Newcomer to adopt a resolution to approve the Master Plan as corrected.  By Roll Call Vote – YES - Amy Hemphill, David Wolf, Susan Newcomer, Jim Brow, and Wendie Shafer.  NO- None.

 

UNFINISHED BUSINESS -   David Wolf presented a letter from Orchard View, LLC requesting a refund of payment for rubbish fees collected for roll carts.  Dave also presented a motion, seconded by Susan Newcomer, detailing a recommendation for reimbursement of Rubbish fees to Orchard View, LLC concerning their two 12 apartment buildings. The documents are included with the minutes.  By Roll Call Vote -  YES – Amy Hemphill, David Wolf, Susan Newcomer, Jim Brow, and Wendie Shafer.  NO – none.  M.C.

 

The Board discussed at length the details of a third draft of a Baroda and Lake Police Protection Agreement derived from a joint conference call on Friday, June 25, 2010 between Baroda Township and Lake Charter Township Board members and Attorney William Fahey.  Dave Wolf moved, seconded by Jim Brow to approve the draft agreement as presented.  By Roll Call Vote – YES- Wendie Shafer, Jim Brow, Susan Newcomer, David Wolf, and Amy Hemphill. 

NO- none

 

NEW BUSINESS – Wendie Shafer reported that Williams & Works has asked for an additional $500 to help cover a portion of the costs they incurred that exceed the amount of their original quote for Master Plan services. After discussion, Wendie Shafer moved to pay an additional $500 to Williams & Works.  Motion failed for lack of support.

 

Susan Newcomer reported that she had been requested by a resident to change the name of Stevensville Baroda Road to something shorter.  She asked who has the authority to change the name of a road.  It was recommended that we should ask the County Road Commission how the process works.

 

Jim Brow reported that Township Attorney, Ben Schwartz has changed Law firms and that we need to decide if we want to stay with Troff,  Petzke & Ammeson, retain Ben as our attorney and move our records to his new law firm, or engage an entirely new firm for our legal services.  It was thought that questions should be asked about service fees and who might be assigned to represent the Township.  No action was taken, pending further information.

 

CONSENT AGENDA - Copies of the minutes of the May 17, 2010 Baroda Township Board meeting and Baroda Township Bills for the month were distributed.  After discussion, David Wolf moved, seconded by Wendie Shafer to approve the Minutes of the last Board meeting, the Treasurers' Report and the Township Bills.

Vote – All Yes.  Motion Carried.

 

SUPERVISORS COMMENTS – Jim Brow reported that the Township is to be assessed $536.92 for work on the Williamson Drain.   He reported that tomorrow at 9:45 he would get an update on the Sparling & Gonder Drain on Landon Road.  Dave Wolf asked what the name is of the Drain that goes behind Ed Heyn’s previous home.

 

Jim Brow reported that a resident had asked him how to dispose of extra garbage resulting form  the power outages from last week end’s storms.  Jim called Henry Valkema from Michiana Recycling and Disposal who advised him that if there were only a few homes affected, he would pick up extra garbage bags placed next to the roll carts.  If there were a lot of extra bags to pick up, he would have to charge extra for the additional service.

 

Susan Newcomer mentioned that a couple of people who live on Keehn Road would like it to be left a gravel road because they like the fact that there is less and slower traffic on the road.

 

PUBLIC COMMENT- Teri Freehling invited the Township Board members to come to their property to view the drain work that was done on the Fowler drain.  She is concerned that measures need to be taken for erosion control.

 

ADJOURNMENT - The meeting was adjourned by Supervisor Jim Brow at 8:45 p.m.

After the meeting adjourned the Board members took a tour of the section of the Municipal building vacated by the Police Department to discuss remodeling, repairs and use of the area. The next regular meeting of the Baroda Township Board is scheduled for Monday July 19, 2010 at 7:30 p.m. in the Municipal Building.
