David Schultz, Acting Chair called the meeting to order at 6:32 p.m. in the Baroda Township Municipal Building Meeting Room. There were seven audience members.

 

The minutes of the September 14, 2009 Planning Commission meeting were distributed and discussed.  Dean Schmaltz moved, seconded by Ed Heyn to approve the minutes as corrected.  Vote - All Yes. Motion Carried. 

 

Building Inspectors report - Howard Gaul reported issuing building permits for: James Hemphill on Hills Rd. for a Front Deck, Galalnda – a 10’ X 16’ Shed, Add’l Storage – 40’ X 48’Commercial Storage Building and a 40’ X 56’ Commercial Storage Building, Ken Pinkowski at 225 Spring Rd. replacing a 14’X 28’ shed, Larry Klug rebuilding garage and repairing foundation, Eric Wagner – a 700 Sq. Ft. house addition and kitchen and other remodeling.

 

Zoning Administrator’s report – Jim Pheifer reported having issued a Zoning Permit to Luke Brown for an agricultural Pole Barn.

 

David Schultz announced that the order of the agenda would be changed to address the Worthenbury Tourist Home review and to add David and Deborah Maki to the agenda.

 

OLD BUSINESS – The public hearing date for David Leslie’s Special Land Use Public Hearing concerning an application for a Tourist Home was rescheduled to Wednesday, October 28, 2009.

 

Ed Heyn asked if any action had been taken by the Township Board to have Durwood D’Agostino clean up the road front at his Shawnee Rd. Business.  Wendie reported that Jim Brow had contacted Kim Fowler, Ordinance Enforcement Officer, but did not know if he had indeed spoken with him.

 

NEW BUSINESS – David and Danielle Maki introduced themselves to the Planning Commission. The stated that they are in the process of procuring a small wine manufacturer’s license and will soon submit an application for a Special Use Permit for “Old shore Winery”.  They plan to have no public access or tasting at their site.  They plan to sell the small quantities of wine they make to commercial businesses, local restaurants and on-line.

 

 

The Planning Commission reviewed the Special Use Permit for Steve Salisbury’s Worthenbury.  Howard reported that he had re-inspected the Worthenbury home and that the building is in compliance with State requirements for all items.  After discussion acting chairman, Dave Schultz declared that the Worthenbury home is in compliance and is granted a continuance of the Special Use Permit for his Tourist Home.

 

 

 

David Schultz opened the floor for Audience comment concerning the Mark Schutze Snowmobile Pond races.  Persons speaking concerning renewing Mr. Schutze’s permit were:

Diane Warmbein, Bill Warmbein, Patricia Daniels and Tom Daniels, John Byrdak.  Most thought that the loudspeakers at the events were too loud.  Annoyance with the Helicopter rides noise was also noted.  One person said that there was no fencing along the neighboring property line as required in the conditions of the permit. Three letters were received by the Township Clerk in opposition to renewing the permit.  The decibel report done by Kim Fowler (a certified decibel machine operator), and Supervisor Jim Brow, and the Police report supplied by Chief, Gary Ruhl were read aloud by David Schultz.  The reports showed noise levels to be between 76 and 93 decibels, about the same as normal street traffic and had been taken from various locations in the race site vicinity.  Concerns about an on-site sign for NIMBY POND were raised.  It was explained that an On-site sign is a permitted use in the Ag zone. And that the sign is within the maximum size limitations.

 

The Planning Commissioners asked John Byrdak questions as Mr. Schutze’s advocate because Mr. Schutze was not present at the meeting.  Mr. Byrdak related that as far as he could tell, all the conditions of the Permit had been met.  Since there were questions as to items # 11, demarcation of neighboring properties, and # 25 the size of the loudspeaker, it was decided to send a letter to Mr. Schutze requesting a written answer to the questions posed, and to invite him to attend the next meeting.  No action was taken on the renewal of Mr. Schutze’s Special Land Use Permit.

 

ADJOURNMENT – The meeting was adjourned by David Schultz at 7:44 p.m.  The next regular meeting of the Planning Commission is to be held on November 9, 2009.   A special meeting is to be held Wednesday, October 28, 2009 to hear public comment on a Special Land Use Permit application submitted by David Leslie for a Tourist Home.
