Tom Lippert, acting chairman called the meeting to order at 6:40 p.m. in the Baroda Township Municipal Building Meeting Room. There were three audience members.

 

The minutes of the December 2009 Planning Commission meetings were distributed and discussed.  Wendie Shafer moved to approve the minutes of the December 2, 2009 meeting, seconded by Ed Heyn. Vote - All Yes. M.C.  Tom Lippert moved, seconded by Ed Heyn to approve the minutes of the December 14, 2009 meeting. Vote – All Yes. M.C.

 

There was no Building Inspector’s report.  Jim Pheifer reported that he had reviewed no requests for any zoning permit or any applications in the past month.

 

OLD BUSINESS – Ed Heyn asked if anything was happening with the Ellsworth situation.  Wendie Shafer reported that Mr. Ellsworth has spoken with an auctioneer and is preparing for two auctions to be held in 2010. Ed Heyn also asked if anyone has spoken with Durwood D’Agostino about the eyesores at his property.  Wendie Shafer reported that Kim fowler had talked with Mr. D’Agostino and that if the County Drain project goes through that he plans to bid on, the drain tubes will be used for that project.  Tom Shafer asked if Wendie had reported on the acreage of Baroda Township farmland in PA 116.  She said that just less than 900 acres are enrolled in PA 116.

 

There was no new business.

 

PUBLIC HEARING – Tom Lippert called the public hearing to order for the purpose of hearing public comment on an application for a Special Land Use Permit submitted by David and Danielle Maki for the operation of a small winery.  Mr. Maki was given the floor.  He described the proposed operation.  He answered questions from several Commissioners.  Chairman Lippert asked for other Public Comment.  There was no other public comment.  The Public Hearing was closed.

 

The commissioners discussed the terms of the application and whether it met the eight conditions of the basis of determination.  By roll call vote:  Tom Lippert agreed that the proposed Special Land Use complies or meets the conditions of all of the eight conditions of the basis of determination.  Tom Shafer agreed that all eight points are met by the application; Dean Schmaltz agreed that the eight conditions are met in the application; Ed Heyn agreed that the eight points of the basis of determination have been met, and Wendie Shafer agreed that the eight points of the basis of determination have been met.  Tom Lippert moved, seconded by Ed Heyn to approve the Special Land Use Permit for the Makis to operate a small winery for manufacturing purposes only as proposed in their application.  Vote – All Yes.  The Application for a Special Land Use Permit for the Makis to operate a small winery is approved.

 

ADJOURNMENT – The meeting was adjourned by Tom Lippert at 7:08 p.m.  The next regular meeting of the Planning Commission is to be held on February 8, 2010.
